Problem summary
While in the Modo layout and in the Topology toolbar if you select either the Topology Pen or Pen tools, the Background constraint can't be disabled.

Steps to reproduce

1) Go to the Modo layout and select the Topology toolbar

2) Select the Topology Pen, and notice how the Background constraint is enabled.

3) Deselect the Background constraint by pressing the button in the UI above the 3D viewport, notice how it drops the tool.

Expected behaviour
When you disable the Background constraint the tool should still be selected.

Actual behaviour

Deselecting the Background constraint drops the tool.

Workaround
Select the Pen or Topology pen tools from the Model toolbar.
