Steps to reproduce
 
1) Launch Modo and load provided scene.

2) In the viewport hold Shift and click on each cube to select them all.

3) In Model Tools the option to Merge or Unmerge will be grayed out.

 
Expected behaviour
When selecting multiple mesh items in the viewport the merge and unmerge options should be available just as when you select them from the Item List.
 
Actual behaviour
After selecting the items in the viewport the merge and unmerge options are not available from the Model Tools.
 
Workaround
Select the items in the Item List.
